Terms and Conditions of Entry

  1. How to enter
  • To enter the Hunter Young Business Mind Awards all applicants must read and understand the terms and conditions and complete the on-line entry form for your chosen category.
  • All submissions are to be lodged through the Hunter Young Business Mind Awards website ybma.com.au (Website).
  • By lodging your submission, you agree to be bound by these Terms and Conditions of Entry.
  • Instructions on how to enter the Awards as set out on the Website (Guidelines) form part of these Terms.
  • Your entry must be submitted by 5pm Australian Eastern Standard Time on the relevant close date for your region, as published in the Key Award Dates section on the Website.
  • The Hunter Young Business Mind Awards Committee reserves the right to extend or vary the entry period if required, before or after the award entry period commences.
  1. Entry Eligibility

2.1. Entrants into the Hunter Young Business Mind Awards program must meet the Entry Eligibility criteria as set out on the Website.

  1. Entry requirements
    • All entries (including both the entry form and video) must be lodged online and include the required information.
    • The Hunter Young Business Mind Awards Committee reserves the right to declare any entry ineligible or disqualified if (in our opinion):
  1. during the award process your entry form or video is incomplete or deficient, provided unlawfully, false or misleading in any way; or
  2. you or your school have not complied with these Terms, the Guidelines or Entry Eligibility Criteria.
  • If you or your school are involved in any conduct or activity in any way that:
  1. is illegal or fraudulent;
  2. may harm us, our name or reputation; or
  3. breaches these Terms,

we may, in our discretion, withdraw any award and associated prizes that you have received.  If requested by us, you agree to no longer publically promote yourself, your business or school as being associated with the Awards, us or the sponsor.  This clause survives the expiration of these Terms.

  • Your entry will be allocated to the Hunter Region Local Government Area judging panel based on the location of your/the school.
  • All Regional Finalists must make arrangements to be available to attend the Regional Final Gala Event and associated events including judging days (if any), as determined by us in our sole discretion.

    • The Hunter Young Business Mind Awards Committee reserves the right to extend or vary the entry period if required, before or after the award entry period commences.

  1. Confidentiality, Privacy & IP

6.1. All information provided in each entry will be used for the purpose of judging only and will be treated as commercial-in-confidence by the Hunter Young Business Mind Awards Committee.
6.2. If you are selected as a Regional Finalist, information provided in the entry will be used for the purpose of promoting the Awards and your entry.
6.3. As part of the awards judging process, we collect personal information (as defined under the Privacy Act 1988 (Cth)) and other information relating to your entry in various ways, such as in the Awards entry form, on judging days, in your video, and in speeches and interactions with the support team and Committee to administer the awards and, where appropriate, award prizes.  If you do not provide the personal information requested, you cannot participate in the Awards.
6.4. By participating in the Awards in any way (including by submitting an Awards entry), you consent for us to use and disclose your personal information to our related entities, business partners, sponsors and other third parties engaged to provide services in connection with the Awards in order to market to you in any way, administer the Awards, and to invite you to be part of our initiatives and business opportunities.  You agree that your consent continues until you withdraw it by notifying us via email at admin@ybma.com.au
6.5. You agree that we and/or the judges may review publicly available information regarding you including websites, social media and media activity in assessing and judging your entry.
6.6. In submitting your entry for consideration for the Awards, we acknowledge and agree that the entrant will retain all Intellectual Property Rights in connection with the business idea that is the subject of the entry.  Except as expressly provided in these Terms and subject to clause 7, nothing set out in these Terms shall be construed as conferring on us any license or right under any Intellectual Property Rights in your business idea.

  1. Promotion and Sponsorship
    • If your entry is selected as a Regional Finalist, you and/or your school (as applicable) agrees to attend all Awards presentation events and other Awards events that we notify you about, and agrees to assist in publicising the Awards as reasonably required by us.
    • You agree that we and our sponsors and business partners may use:
  1. your business logo (if any) and your personal identity for the sole purpose of promoting the Awards; and
  2. details about you and your idea or business in printed, electronic and online/social media (as we consider appropriate) in promoting the Awards,

without compensation to you.

  • You (or your parent/guardian) agree to allow us to contact you to provide comments about the Awards and to take photos or video footage of you, your business and your school (as appropriate) for the sole purpose of promoting and administering the Awards.
  • Subject to these Terms, we may duplicate and utilise your video and entry materials at any time and by any means for the sole purpose of promoting the Awards and other reasonable related activities.
  1. Judging
    • All entries are judged by a panel of subject matter experts, selected at the sole discretion of the HYBMA Committee from subject matter experts or practitioners in the areas of creativity, entrepreneurship or business.
    • Judges are required to sign a confidentiality agreement and disclose any conflict of interest.
    • The judges’ decision is final and no further correspondence will be entered into after a decision is made. We do not provide feedback on entries.
  1. Awards
    • The Awards comprise of the following categories:
      • Best creative thinking for a business idea or an existing business run by a student;
      • Best creative idea for a business or social enterprise developed by a class or school.
    • The top two scoring entries for each category from a Local Government Area will progress to the regional final.
    • If we (or the sponsor) are unable to provide a winner with a nominated prize, we (or the sponsor) reserve the right to supply an alternative prize of similar monetary value. We accept no responsibility for any variation in the retail value of the prize pool.
  1. Announcing the finalists and winners
    • Finalists will be notified by phone and email, and published on the Hunter Young Business Mind Awards Website.
    • Winners will be announced at the HYBMA Regional Finals Gala Event.
  1. General
    • We accept no responsibility for entries not received by us for any reason.
    • In our sole discretion, we have the right to alter or cancel part or all of the Awards at any time.
    • We are not liable for and you indemnify us from and against any liability, loss, injury or damage which results directly or indirectly from the Awards including the breach of these Terms or any third party intellectual property rights.
    • You acknowledge and agree that it is your sole responsibility to commercialise your business idea (should you wish to do so) and we do not warrant, represent or guarantee any contribution or involvement with your business except for the Awards process in accordance with these Terms.
    • Prizes are not transferable or exchangeable and cannot be redeemed for cash. Terms and conditions of use apply to the prizes and all prizes must be claimed by March 20, 2018.
  1. Definitions
    • The Hunter Young Business Mind Awards (HYBMA) (the “Awards”) are conducted by Hunter Futurepreneurs of Suite 2 1 Kenrick St The Junction NSW 2291 (“we”, “us”, “our”).
    • In these terms and conditions of entry (Terms), unless otherwise stated:
  1. a reference to “you” or “your” includes you in your personal capacity and/or as a representative of your school, or your school itself, as the context requires;
  2. Intellectual Property Rights means all present and future intellectual property rights, whether registered or not, including without limitation, copyright, patents, rights in inventions, know how, trademarks, business names, design rights and rights of a similar nature that exist or that may come to exist, anywhere in the world;
  3. Website means the Hunter Young Business Mind Awards website at www.ybma.com.au
